1.) Express Assumption of Risk, Loss of, Damage, Injury or Illness to Equipment or People

I understand that participating in a photo or video shoot at the Flagship Product Photography studio or other facility or location and including during any transportation provided by vehicle or other similar means to other locations, whether indoors or outdoors, with related equipment, props and other items, but not limited to, light stands, furniture, wires and cables, slippery shoes and floors or ground, and more, can result in injury to people and damage or harm to equipment or the facilities or locations. I also understand the consumption of any foods or beverages at any of these locations or during transportation, or simply being present at a location, may cause unknown illnesses, sicknesses or injury. By my signature below, and as a condition of my being allowed to be in or use the Flagship Product Photography's facilities located in or around the building at 699 E Colorado St, Glendale, CA, and as a condition of working with Flagship Product Photography, its employees or representatives at any other indoor or outdoor location, I expressly assume all risks of damage, harm, injury, illness or sickness and I release Flagship Product Photography from all claims or responsibilities for any damage, harm, injury, illness or sickness including by way of illustration but not limitation, those resulting from negligence, accidents or injury to myself, members of my family, my friends or equipment while on the premises or surrounding areas of the Flagship Product Photography property or during transportation to or from a location or while at any other indoor or outdoor location for the purposes of a photo or video shoot with Flagship Product Photography, its employees or representatives.

I agree to abide by all rules established by Flagship Product Photography staff, in writing and/or verbally conveyed, when I am at Flagship Product Photography premises or elsewhere. While I am on the premises of Flagship Product Photography or working with Flagship Product Photography at any location, I will take all precautions necessary to insure the safety of myself, of other people, and of all property and equipment.

Parental or Guardian Consent and Acceptance

I am the parent/guardian of the below named minor(s) and, in consideration of his or her being allowed to be present at or using the facilities, equipment and other items at the Flagship Product Photography premises, or other locations for photo or video shoots, and during transportation to or from a location, I agree to be bound by all the terms and conditions of this Express Assumption of Risk, Loss of, Damage, Injury or Illness to Equipment or People. I accept full responsibility for the cost of treatment for any injury suffered by him or her, or anyone during photo or video shoots with Flagship Product Photography.

2.) Permission for Photography and Video & Understanding of Work Terms

For valuable consideration received, I grant “Flagship Product Photography” and its employees or representatives (collectively referred to hereafter as “Photographer”), the following rights and unrestricted permission concerning any photographs or video that Photographer has taken or may take of the minor or in which the minor may be included with others. I grant Photographer the right to use, reuse, publish, and republish the photographs in whole or in part, individually or in connection with other material as a service to provide me with finished photos or video. I also grant Photographer the right to use the photos or videos only to promote Photographer’s business on the company website and online social media profiles, such as but not limited to, Instagram, Facebook, and Google Business, or on a flier or similar document. I release and discharge Photographer from any and all claims and demands that may arise out of or in connection with the use of the photographs or video, including without limitation any and all claims for libel or violation of any right of publicity or privacy. I acknowledge that, as established by US copyright laws, Photographer retains copyright to photos and video Photographer produces. I understand for any files or printed photos Photographer provides me that I am granted only a license to use them for posting to online business or social media profiles or to submit in print for castings or employment but not for sub-licensing or for intended direct monetary compensation for my likeness.. I release, discharge, and agree to hold harmless and defend Photographer, its legal representatives or assigns, and all persons acting under its permission or authority or those for whom it is acting, from any liability by virtue of any reason in connection with the making and use of such photographs or video, including blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said pictures or video or in any subsequent processing thereof, as well as any publication of them, including without limitation any claims for libel or violation of any right of publicity or privacy. I acknowledge an understanding that photographer only provides extra photos at his discretion and even then only extra photos that photographer deems as usable, which generally are provided as web-quality JPEG files of approximately 1,600 ppi size (long edge). I also agree that by paying for the services or selecting photos to have retouched I confirm my approval for the work and services provided. I also acknowledge an understanding that photographer, by US copyright law, does not have to or shall not provide original files – also known as RAW files. I hereby warrant that I am a legal competent adult and a parent or legally appointed guardian of the minor, and that I have every right to contract for the minor in the above regard. I state further that I have read the above authorization, release, and agreement, prior to its execution, and that I am fully familiar with the contents of it. This release shall be binding upon the minor and me, and our respective heirs, legal representatives, and assigns.
